Please read the following agreement. If you have any questions, ask for clarification.
Terminology:
Seller: Triangle Goldendoodles or any of its designated representatives.
Buyer: The purchaser of the puppy (you).
DOP: Date of possession; the date and time in which the BUYER takes possession of the puppy either by pick up, personal delivery or by pick up at the airport terminal.
DOB: Date of birth; the date which the puppy is born.
GUARANTEE:
The SELLER, to the best of our knowledge, guarantees the BUYER at the time of delivery, the puppy is in excellent health condition and has all age appropriate de-wormings and vaccinations. We guarantee that your puppy will be free of all terminally genetic diseases and moderate or severe Hip Displysia for two years from the puppy’s birth. We guarantee your puppy to be free from the Parvo virus and Distemper on the puppy’s DOP.
CONDITIONS:
The BUYER must either sign this contract in person on the DOP and hand it immediately to the SELLER (if delivery is made in person) OR return it to the SELLER by US Mail postmarked within 7 days from the DOP. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
The BUYER also has 5 days from the DOP to have the puppy examined by a licensed Veterinarian and have a copy of the results of this examination returned to the SELLER by US Mail postmarked within 7 days of the DOP. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
At the time of this initial exam, should your licensed Veterinarian find the puppy in poor health or detect any physical health problems that would require further veterinary care (excluding required vaccinations and/or treatment for any type of parasite, worm or bacteria, internal or external), the BUYER must contact the SELLER via phone or email within 24 hours from the time of this diagnosis. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
The BUYER must not allow the puppy to come in contact with the floor or any other publicly accessible surfaces of the Veterinarian's office (i.e.: office waiting areas and grounds outside the Veterinarian's office) for any reason because of the possibility of contracting the Parvo virus. The BUYER must also ensure that the puppy hasn’t been taken to any type of pet supply store of any kind until all vaccinations have been given. This applies to vet services offered by pet stores. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
SELLER will not replace or refund for any reason such as but not limited to: allergy, mortality, landlord’s disapproval, and disagreement of family or any other problem not related to health. SELLER will not replace or refund for a puppy’s illness caused by neglect, exposure to weather, injury, choking, poisoning, etc. No warranty or guarantee is made to the disposition, life-span, size, color, show quality, or breeding quality of any puppy. SELLER is not responsible for any veterinary bills and other expenses.
EXCEPTIONS:
Should your Goldendoodle be found to have a terminally genetic disease within two years from the puppy's DOP, the BUYER must provide the SELLER with proof in the form of documentation signed by the Licensed Veterinarian who diagnosed the disorder. All genetic diseases must be validated by a licensed Veterinarian and a copy of the results returned to the SELLER via US Mail postmarked within 7 days of the diagnosis. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
Should your Goldendoodle be found to have moderate or severe Hip Dysplasia, within two years from the puppy's DOP, the BUYER must provide the SELLER with proof in the form of official documentation from PennHIP (The University of Pennsylvania Hip Improvement Program) or OFA (Orthopedic Foundation for Animals). A copy of this documentation must be returned to the SELLER via US Mail postmarked within 14 days of the diagnosis from PennHIP or OFA. If the dog, at any time during the first year from the puppy's DOP, was allowed to become overweight, or have its joints to be overstressed, then this will result in the cancellation of this guarantee. It will be null and void.
Should your Goldendoodle be found to have contracted the Parvo or distemper virus any time before the DOP, the BUYER must have the ELISA (Enzyme-linked immunosorbent assay) test performed by a licensed Veterinarian and a copy of the results returned to the SELLER via US Mail postmarked within 7 days of the diagnosis. Failure to do this will result in the cancellation of this guarantee. It will be null and void.
Should any of the conditions above be discovered, and all requirements outlined in this document relating to that condition be met, the SELLER will provide the BUYER another puppy or refund of the purchase price minus shipping costs and any other costs incurred by the SELLER during the process of resolving the issue. The SELLER is not responsible for any costs incurred by the BUYER associated with the treatment or diagnosis of the puppy. All costs associated with the diagnosis and treatment of the puppy is the exclusive responsibility of the BUYER. The SELLER does NOT require the BUYER to return the affected dog in the event of an exchange or refund. We the SELLER reserve the right to confirm any of these results via independent Veterinarian examination before a replacement or refund is given. Results of this Veterinary examination will be the final deciding factor as to whether a refund or replacement will be given.
RE-HOMING:
The SELLER offers a lifetime re-home policy on all of the dogs bred at Triangle Goldendoodles. Should it become necessary, at any point during the dog's life, that the BUYER can no longer keep the dog for any reason, the BUYER agrees to return dog to the SELLER so that we may re-home the dog. The BUYER must contact the SELLER to request a re-home. The BUYER will be responsible for all financial costs associated with the dog's re-homing. If the BUYER re- home's the dog without the SELLER's permission, this guarantee will be canceled. It will be null and void.
BREEDING RIGHTS:
The BUYER must be upfront about planning to breed. The SELLER will give permission to breed for $1500, in addition to the stated purchase price. The SELLER requires this fee upfront before the BUYER takes the puppy home. If the BUYER is unsure about whether they want to breed the dog in the future, this fee is still required. If the fee is not paid and the BUYER breeds the dog, then the SELLER has the right to take the dog back. This is not an ideal option for the SELLER or the dog, so please be conscientious when making the decision to breed.
MAINTENANCE:
The BUYER agrees to keep this dog in good health by providing preventative health care including, but not limited to: Providing routine vaccinations, treatment for internal and external parasites, heart worm prevention medication, flea and tick prevention medication, regular baths, grooming, proper housing and any other procedure or medication that a licensed Veterinarian would recommend as necessary for the proper upkeep of the dog. Upon execution of this contract all veterinary care and its associated costs are the sole and exclusive responsibility of the BUYER. Failure to do any of the above will result in the cancellation of this guarantee. It will be null and void.
TRANSFER OF GUARANTEE:
This guarantee is for the original BUYER only. This guarantee is NOT transferable.
I, as the buyer or his/her representative, of this puppy, have read, understand, and agree to the above guarantee. Acceptance of the puppy or puppies constitutes acceptance of this agreement.
